Abstract

Mobility-as-a-service is the integration of various forms of mobility services, which provides an user-centered environment by enabling a single search, reservation, and payment of various mobility services. While the mobility-as-a-service includes various transport and mobility services, the success of this service depends on many laws and regulations related with the various mobility services. With this in mind, this study aims to perform an in-depth investigation on the current state of domestic and foreign laws and regulations of mobility-as-a-service, compare the law and regulation status in Korea and foreign countries, and ultimately assess the law and regulation status of Korea and provide suggestions for reforming the related laws and regulations in the view of mobility-as-a-service utilization maximization. The fields of laws and regulations investigated include public transit, private mobility service business, transportation/mobility service user rights and interests, private data protection and security, insurance and legal liability, anti-trust companies, and support for new industries. The countries investigated include the European Union, the United Kingdom, France, Germany, and Finland in Europe, California and New York states in North America, and Japan, Australia, and Singapore in the Asia-Pacific region. Based on the investigation of laws and regulations worldwide and the comparison of legal status and readiness of mobility-as-a-service, this study provides implications and recommendations to reform and revise the related laws and regulations in Korea.

통합이동서비스(Mobility-as-a-service, MaaS)란 단일 플랫폼으로 이동에 필요한 경로 탐색, 수단선택, 예약 및 결제 등의 서비스를 한 번에 이용할 수 있는 환경을 제공해주어, 개인의 특성과 이용 가능한 교통수단을 고려하여 출발지에서 목적지까지의 이동서비스에 대해 다양한 대안을 제시해주는 서비스이다. MaaS 산업의 등장 및 확산에 따라 국내외에서는 MaaS 산업을 발전시키고 활성화하기 위해 공공 ‧ 민간영역에서 다양한 노력을 하고 있다. 무엇보다 MaaS가 활성화되기 위해서는 법제적 장벽 또는 정책적 장벽이 없어야 하며 규제수준이 완화되어야 한다. 이에 따라 국내외 MaaS 서비스 관련 법 ‧ 제도에 대한 조사 ‧ 분석 및 시사점 도출을 통해 국제적인 법제 정비 방향을 연구할 필요성이 있다. 본 연구는 MaaS 산업의 발전을 위해 국내외 법 ‧ 제도 현황을 조사하고 이를 법제 차원에서 깊이 있게 분석하였다. 또한, 국내 법제 준비수준과 국외 법제 준비수준의 차이를 심층 조사함으로써 해당 산업과 관련된 국내 법제 개선 방향을 도출하였다. 분석 결과 국내의 경우 민간 모빌리티 서비스 중심 여객운수사업 관련 분야에서 여객자동차 운수사업법의 여객자동차운송플랫폼사업 관련 법률을 통해 플랫폼 택시를 제도화하고 현행 제도의 운영상 나타난 미비점을 보완하였으며 개인정보 보호 관련 분야에서 가명정보 개념과 개인신용정보전송권을 도입함으로써 두 가지 분야에서 비교적 법제적으로 높은 준비수준을 나타냈다. 사고 및 보험 관련 분야에서는 MaaS 사업의 고유한 특성들을 반영하여 발생 가능한 손해를 포괄적으로 보상하는 일본의 MaaS 보험에 대해 참조할 필요성을 나타냈으며 신산업 지원 관련 분야에서는 규제 특례가 적용된 핀란드의 Whim 개발과 대중교통 혁신법(49 U.S.C Section 5312)을 통해 예산이 지원된 미국의 MOD, IMI 사업에 대해 참조할 필요성을 나타냄으로써 국내 법제 개선 방향을 제시하였다.
